摘要: 传统抵押权追及效力理论仅以不动产抵押为假设对象,动产抵押的兴起对其产生了强烈的冲击。其实,传统抵押权追及效力理论内蕴含着对于第三取得人善意恶意的价值判断,并且其逻辑起点应为抵押权不受影响,而且抵押人设定抵押权后,一旦债务人届期不履行债务,则其转让行为对于抵押权人无效,因为此时其处分权受到限制,但是善意第三取得人可以基于善意取得的规定终局地获得抵押物的所有权。

Abstract: The traditional.hypothecation recourse theory targets the real estate hypothecation which is heavily influence by the flourish of the chattel mortgage.Actually,the traditional.hypothecation recourse theory embraces the value judgment of the third party’s intent and its logic is following the track that the hypothecation will not be touched and when the hypothecation is set the transfer of the debtor will not have any force to the person with the hypothecation in case the debtor will not perform the obligation.However,the third party with good intent will finally win the ownership of the collateral。
