摘要： 现代国家的规制系统往往是复杂而庞大的。在政府对经济的规制中，应当否定和废止的规制大量存在，同时，应当肯定和强化的规制同样大量存在。本论文将视角锁定在经济规制立法的正统性分析上，着重探讨如何在立法和制定政策的过程中实现意思决定的科学性、专门性，强调对各种信息的梳理、排除和活用，围绕立法和政策制定的“科学公正性”和“社会公正性”以及由此而得以确保的“社会可靠性”展开探讨，在“民主参与”、“专门性输入”及评价、救济等“专门性保障”的意义上，来构筑规制立法和政策形成的“正统性”。

Abstract: The regulation system is complex and huge in modem society．There exist many economic regulations that should have been negated and revoked and also there exist many economic regulations that should be affirmed and strengthen．This thesis focuses on analyzing the legitimacy of legislation of economic regulation and aims to institute the legitimacy of law-making and policy-forming in the sense of democratic participation，special input and special security such as evaluation and remedy by probing into the scientificity and professionalism of decision in law-making and policy—making，emphasizing on arranging，excluding and applying various data，and discussing the scientific justice and social justice in the process of law-making and policy-making and social dependability．
