摘要： 在现代法学体系中，法理学原是西方科学知识的一部分，但大凡自成系统而有特色的法律文化都有自己的法理。传统中国的法理是我们的先贤关于法的基本问题的实践理性和历史经验的凝结，是作为一种文明秩序的中华法系的共通理论。本文概括地探讨了传统中国的法观念、法秩序、法运行，以及法的理想和原理中的法理义蕴；提出传统中国的法理从有机的自然／世界观出发，以道德为原理，立足全体、效法自然、追求和谐，赋予了传统中国法责任一权利的结构、道德的精神和人类全体以及人类与自然共生共荣的价值目标；它沟通自然与社会、多元一体、责任优先、综合为治，贯注了德性为上的人的文化理想。这些法理义蕴在当代中国的法理学学科建设和法制化进程中，具有文化资源和主体建构方面的意义。

Abstract: In modern legal systems, jurisprudence is originally a part of western scientific knowledge, but almost all le-gal culture which is self-made system and distinctive has legal principle of its own. Traditional Chinese legal prin-ciple is the condensation of practical reason and historical experience of our sages on the basic issues of law,which is the common theory of the Chinese legal system as a civilized order. This paper briefly discusses the legalconcept, legal order and law-operation of traditional China, as well as the legal sense in the ideals and principlesof law. It proposes that traditional Chinese legal principle, starting from organic natural/world view, takes moral-ity as its principle, bases itself on the whole, follows the nature and pursues harmony, providing traditional Chi-nese law with structure of right-responsibility, moral spirit and value targets of coexistence and prospering betweenthe nature and mankind as a whole. It communicates the natural and society, being diversity and unity, takingresponsibility in priority and ruling by way of integration as it is permeated with the human’s cultural ideal ofvirtue being supreme ．These legal senses，significant in the aspect of cultural resources and subject-construc-tion in construction of jurisprudence as a discipline and the process of legalization in contemporary China.
