摘要： 在知识产权制度的起源和发展过程中，知识产权法规范始终渗透和交融着关涉市场的立法理念、原则和规则。从历史沿革、法律价值和法律利益等方面进行分析，可以发现知识产权法是市场本位法。这一定位是由创造在劳动方面的性质和知识价值实现所决定的。贯彻知识产权法市场本位，强化知识产权法与相关政策之间的协调与互动，更能保障知识产权制度价值的实现。

Abstract: In the origin and development of intellectual property system, intellectual property law critenon is alwayspenetrated and blended with the legislation idea, principles and rules relevant to the market. The analysis of itshistory, legal value and legal interests, etc, shows that intellectual property law is market oriented, resultingfrom the innovative character of labor and knowledge value realization. Implementing intellectual property marketstandard, strengthening the co-ordination and interaction between intellectual property law and related policy,should ensure the system value realization of intellectual property law.
