摘要： 应对气候变化与国际技术转让密切相关。虽然《联合国气候变化框架公约》、《京都议定书》等规定发达国家承担环境友好技术转让的义务，但由于这些规定存在不足及多数技术掌握在跨国公司等私人手中，相关技术未能充分转让。为此，人类应以现有有关规定为基础，以《哥本哈根协定》的落实及《坎昆协议》的国际法制化为契机，推动多哈回合谈判，将环境友好技术转让与贸易挂钩，制定WTO框架下的国际技术转让协定，促使发达国家的政府承诺与其国内跨国公司等私人主体的技术转让行为一致，使发展中国家在公平合理的基础上获取技术，走可持续发展之路。

Abstract: There is a close relationship between countermeasures for climate change and international technology trans-fer. Although the United Nations Framework Convention on Climate Change and the Kyoto Protocol and othertreaties contain the provisions concerning environmentally friendly technology transfer, technologies have not beentransferred smoothly in the globe owing to the flaws in the provisions and the fact that most technologies are pos-sessed by transnational corporations and other private sectors ．In order to make the promises committed by thegovernments of developed countries and commercial activities of their private sectors conformed to each other andpromote technologies transferred to the developing countries effectively in post-Copenhagen era, an uniform inter-national technology transfer agreement shall be established under the World Trade Organization on the basis of theprovisions scattered in related current international treaties with the combination of technology transfer and trade,which shall take the implementation of Copenhagen Accord and the legalization of Cancun Agreement as the op-portunity to advance the Doha negotiations.
