论异议登记的法律效力与构成要件

摘要: 异议登记是《物权法》借鉴比较法(主要是德国法)的立法模式规定的一种新的登记类型。如何理解异议登记的法律效力直接决定了其构成要件的设置。我国现行不动产登记的地方性法规和部门规章规定异议登记具有限制处分效力,既不符合异议登记的本质,也有违《物权法》立法本意。异议登记仅应具有暂时击破登记簿公信力的效力,它既不能限制登记权利人的处分,甚至无法推翻登记簿的推定力。在正确界定异议登记效力之后,可厘清异议登记的构成要件:首先,登记主体为利害关系人;其次,异议登记的客体—不动产登记簿上可能存在的错误权利事项;最后,异议登记的申请不以权利人不同意更正为前提。

Abstract: The registration of protest is a new type of registration, which is stipulated by the Art. 19 Ⅱ of CPL(ChinaProperty Law).The problem about effects of protest registration is very important. It plays a major role in thesystem of protest registration. In China the registration of protest means that the interested party questions the cor-rectness of the real estate register. It can temporarily destroy the real estate register's public reliance and preventthe acquisition of real estate in good faith, but can not negate the presumptive correctness of the register and re-strict the disposition of the holder registered in the real estate register. This understanding about the effect of protest registration is not only of great help to stipulate the elements of protest registration and the scope of propos-er, but also useful to deal with the relationship among the protest registration, the registration of priority not iceand the action preservation.
