摘要: 抵押权的实现是抵押权最重要的效力。抵押权的实现途径如何设计,直接关系到抵押权人的利益保护和抵押担保交易的正常运行。基于我国对抵押权实行司法保护的立法传统,《物权法》第195条第2款对《担保法》第53条第1款的规定进行了补充与修正,赋予抵押权人直接申请法院强制执行抵押物的权利。这一程序在性质上为非诉执行,法院作出准予拍卖、变卖抵押财产的裁定,即为执行名义。据此名义,法院可依强制执行程序对抵押财产进行拍卖、变卖。

Abstract: How to design the means of realizing the mortgage right is directly related to the mortgagee’s interest protection and the normal operation of mortgage guarantee transaction. Section 2 of article 195 of Property Law stipulates that: where no agreement on the means of realizing the mortgage right is achieved, the mortgagee may require the people’s court to auction or sell off the mortgaged property. This procedure in nature is non-contentious execution. The court granting the auction or selling off the mortgaged property ruling is the basis of execution.
