街头政治的形成:城管执法困境之分析

摘要: 随着中国城市化进程的快速发展及城市管理的日益复杂,城管执法中的冲突时有发生,城管执法问题成为关注的焦点。城管执法活动嵌入在特定的执法空间及一定的社会形势和体制环境当中,深受执法空间、社会形势、体制环境所形成的嵌入式执法结构的影响。街头空间是街头政治得以形成的基本场景,体制目标冲突是其体制性因素,多元社会利益结构及社会矛盾是街头政治的深层次根源。在特定的执法结构中,街头政治得以形成,城管执法成为重新界定规则和重新确定利益格局的政治过程。我们需要在把握街头政治形成机制的基础上,探求新的城市治理思路,在法治的动态运行中实现城管执法的法治化,解决城管执法困境。

Abstract: With the rapid development of China’s urbanization and increasingly complex urban management,conflict and violence from time to time ocour in the Chengguan’s exercise of their power(urban management officers),and urban management law enforcement problems become the focus of social attention. Embeddedstructure of law enforcement is the theoretical framework of the formation mechanism of the street politics inChengguan’s law enforcement. Urban management law enforcement activities are embedded in the law enforcement,the social situation and the institutional environment,influenced by the law enforcement,thesocial situation and the institutional environment. The street space is the basic scenario to form street politics. The conflicts of institutional goal are the institutional factors. Multiple social interests structure and socialcontradictions are the roots of the street politics. In the specific law enforcement structure,law enforcementbecomes a process to redefine the rules and the pattern of interests. It is necessary to inquire into the new urban governance approach based on the knowledge about the formation mechanism of street politics and modernize the rule of law in dynamistic enforcement in order to overcome the Chengguan’law enforcement dilemma.
