纪委、检察机关办案规范的整合:一个连接理论与实践的分析路径

摘要: 监察委办案规范的建立面临着转隶前纪委办案、检察机关办案两套存在明显冲突的规范的取舍、统一问题。根据两套规范在初查和立案是否统一,以及以谁为主统一,可以得到四个可能的方案。本文从监察调查权的性质、法治中国建设的要求、方案的效率、改革的必要性和现实可能性等方面论述了较优选项,即应当在初查和立案阶段以原检察机关办案规范为主进行统一,通过法律的有意留白和有限例外协调与纪委办案规范冲突的地方。在具体展开该方案时,不应对法律留白作形式性扩大解释,而应坚持原法律规范的原则性调整,除非有国家权力机关的明确特别规定。应当综合考虑冲突规则背后的价值和意义,寻找新的平衡点,建立监察办案规范。

Abstract: The establishment of the standard of handling cases by the supervisory commission is faced with the selection and unification of the two sets of apparently conflicting standards.There are four possible schemes.This article argues for Scheme 2 from the nature of the power of supervision and investigation,the requirements of China's construction under the rule of law,the efficiency of the program,the necessity of reform and the realistic possibility,which is that in the initial investigation and case filing stage,the former procuratorial organ's case handling standards should be the basis for new standards,and the places that conflict with the discipline commissions case handling standards should be coordinated through intentional gap and limited exceptions.In the specific implementation of plan 2,the formal extension interpretation of legal gap should not be used to evade the original legal norms,but should adhere to the principle of the original legal norms,unless there is a clear special provision by the state authority.The value and meaning behind the conflict rules should be taken into account comprehensively to find a new balance point and establish a standard for supervision and handling cases.
