摘要： 民事诉讼率是一个综合的、中性的指标。本文通过实证数据分析，描述了我国民事诉讼率的变化轨迹，认为诉讼率与我国社会经济发展的水平与平稳性高度相关。诉讼率并非法和权利意识发达程度的衡量指标，法律文化、法律规范数量、司法公信力、非诉讼纠纷解决机制等宏观因素皆有可能影响诉讼率，并试从经济分析的角度，阐明影响当事人对诉讼态度的微观因素。

Abstract: Civil litigation rate is a comprehensive and neutral legal indicator．Through analyzing data of real cases，this dissertation indicates the track of the litigation rate of our country，which highly relates with the level and steadiness of social economic development of our country．It’s also not the index sign of flourishing degree of legal and the rights consciousness Many macroscopically factors like legal culture，the quanitity of rules，credibility of justice and Alternative Dispute Resolution will influence litigation rate．By the way of economic analysis，the paper analyses microcosmic factors which influence litigation rate．
