摘要： 中国社会主义经济法治，是170多年来中华民族自强不息追求现代化进程的一部分。在这个宏大的历史进程中，农业民族、宗法社会的政治传统与现代工商社会的规则体系发生碰撞与交织，变法绝非空喊几句口号或制订法律，而在于立足国情形成中国自己的法治传统。包容性增长、改善民生和实现社会公平正义是社会主义经济法治的重要内涵。主流价值观是法治的道德基础和必要条件，中国社会主义主流价值观应包含中华民族国家文化认同、发展社会主义市场经济和发扬社会主义优越性三个方面。法治以民主为根基，协商式民主是符合中国国情的可行民主模式。中国特色社会主义发展道路及其形成中的政治传统所蕴含的智慧，同样可以贡献于整个人类对未来社会的探索。

Abstract: China's socialist economy should be based on the rule of law, which is a part of the nation's modernizationprocess that Chinese people have pursued indefatigably for the last 170 years. During this great historical cause,the Chinese political tradition, deeply rooted in the agricultural civilization and patriarchal society, impacted onand interweaved with the order and the rules of modem commercial society. Far more than some political slogansor establishing some statutes, China's political and legal reform should engender its own legal tradition from hersituation. Inclusive growth，to improve the livelihood of the people, and to promote social justice and equity arethe significant connotation of the socialist economic rule of law. The mainstream values are the moral basis andnecessary condition of rule of law. Chinese socialist mainstream values consist of the nation-state identity, devel-oping socialist market economy and demonstrating the superiority of socialism. The rule of law rests on democra-cy. Deliberative democracy is the feasible model of the socialist democracy with Chinese characteristics. The so-cialist path of China, conformed to the nation's situation and the political wisdom within, could also contribute tohuman being's seeking for the future society．
