摘要: 法学的“几何学范式”是指运用演绎方法,从第一原则推导出公理、规则,最终构造出整个法律体系的一种范式。从欧洲大陆到英美国家,相关的学者们以几何学范式为指导,不断追寻法学中的第一原则,论证各自第一原则的正当性,运用演绎方法构建法律体系和得出判决结果。大陆法系国家通过几何学范式改变了习惯法无序的状态,实现了法律的体系化;英美法系国家则通过知识的融合,将演绎等几何学方法运用到法律推理和法学教学改革中,加快了法律的科学化进程。中国法学界的论述集中在对几何学范式表现形式和该表现形式存在的必要性上,而少有对其历史正当性的论述。中国法学研究者应当加大对第一原则的探寻及其正当性论证的力度。

Abstract: The Geometrical Paradigm refers to the research paradigm that deductively obtains the general principle and rules from the first principle and ultimately forms an integrated legal system. Scholars in both civil lawsystem andcommon law system were continuously purchasing the first principles and reasoning their legitima-cy under the guide of Geometrical Paradigm, as well as they constructed the legal systems and got the con-viction with deductive method. By using geometrical paradigm, countries in civil law system relieved them-selves from disorder circumstance under the customary law and made their law systematically. Besides, Countries in common law systems accelerated the process of legal science by applying the geometrical meth-ods to legal reasoning and educational reforms. The topic in China focused on the appearance of geometrical paradigm and its necessity, while it is lack of the statement on its historical legitimacy. Chinese scholars need to put more energy on searching for the first principle and reasoning its legitimacy.
