摘要： 从知识史的角度看，法学与科学的交汇，呈现出法律社会科学与法律认知科学两波前后相继的浪潮。这一趋势促使法律学者重新反思法学与科学的关系。传统法学基于“意义无涉”与“价值无涉”两点理由，拒绝对法律问题的科学研究，但这种自我辩护忽视了法律实践的规约性特征和法律价值的科学基础。法律认知科学的温和科学主义研究方式，从新的角度解决法学的固有问题，有助于法律的工具价值与目的价值之实现。在垂直整合的框架中，认知科学、社会科学和传统法学各自占据不同的位置，以合理分工的方式推进法学学术的发展，追求人类知识大汇聚的智识理想。

Abstract: From the perspective of intellectual history，there were two waves of the interdisciplinary study of lawby adopting scientific knowledge. Social science of law and cognitive science of law emerged one after anotherand posed a serious challenge to the traditional legal scholarship. In this new scenario，legal scholars needto reconsider the relationship between law and science. The traditional justifications for the autonomy of legalscholarship，based on meaning neutral claim and value neutral claim，are fundamentally flawed becausethey neglected the prescriptive nature of law and the scientific foundation of legal values. The cognitive science of law，however, might solve these two problems and help legal scholars by providing scientific toolsfor means-end analysis and value assessment. In the intellectual framework of vertical integration，traditionallegal scholarship，social science and natural science occupy their proper positions and contribute to the study of law in their own distinctive ways. This interdisciplinary enterprise expresses the grand ideal of the unityof knowledge.
