摘要：

《监察法》最新确立了搜查、扣押同步录音录像制度。该制度的功能有两个方面：第一，权力规范。以令状主义为代表的权力制衡模式在我国难以实现，以同步录音录像为代表的权力规范模式应运而生。录音录像制度可以对搜查、扣押活动从过程与结果两个方面予以规范。第二，证据鉴真。同步录音录像的兴起可以弥补以笔录鉴真的缺陷，丰富鉴真方法，也适应电子数据鉴真的需要。搜查、扣押同步录音录像制度功能的实现，有赖于录音录像全程录制、妥善保存、随案移送、方便调取、辩方质证。需要注意的是，同步录音录像制度的功能是有局限的，未来要真正地实现刑事程序法治，必须打破侦查程序的高度封闭性，建立强制处分的司法审查机制，推进审判中心主义，完善被追诉人权利的保障体系。

Abstract:

The Supervision Law has recently established a simultaneous recording and video recording system for searches and seizures.The function of this system has two aspects：first，power norm.The model of power checks and balances represented by the writ principle is difficult to achieve in China，and the model of power norms represented by simultaneous recording and video came into being.The audio and video recording system can regulate the search and seizure activities from the two aspects of process and result.Second，evidence authentication.The rise of simultaneous recording and video recording can make up for the shortcomings of authenticating records by writing，enriching authenticating methods，and also adapting to the real needs of electronic data identification.The realization of the function of the simultaneous recording and recording system of search and seizure depends on the entire recording of the audio and video recording，proper preservation，transfer with the case，convenient retrieval and defense cross-examination.It should be noted that the function of the synchronous recording and recording system is limited.In order to truly realize the rule of law in criminal procedures in the future，it is necessary to break the highly closed nature of the investigation procedure，establish a judicial review mechanism for compulsory punishment，promote the realization of trial centralism and improve the protection system for the rights of the person being pursued.
