摘要:

近年来,国际法史的研究开始逐渐摆脱欧洲中心主义,重视非欧洲地区在国际法发展中的作用。这些研究成果强调,以南美洲国家为代表的边缘国家在19世纪末参与到国际法讨论之中,为本国在国际舞台上争取平等地位。在同一时期,中国的外交官和国际法学人也充分参与到国际法世界之中,以国际法为武器,维护国家利益。当时中国面临的国际法问题之核心是废除不平等条约。因此,中国在20世纪早期对国际法理论和概念,特别是生存权和情势变更等,积极进行引入、转译和重新解释,以期为废除不平等条约提供国际法依据。20世纪早期中国修订不平等条约过程中的国际法运用,在国际法世界也引起了广泛讨论。可以说,在国际法的近代发展过程中,中国不是无声的背景和被动的接受者,而是发挥着自身创造性的重要角色。

Abstract:

The study of the history of international law has tired to get rid of Eurocentrism,emphasizing the role of non-European regions in the development of international law.The marginal countries represented by South American countries participated in the international law forum at the end of the 19th century,fighting for equal status in the international arena.In the same period,Chinese diplomats and scholars of international law also fully participated in the same field,using international law as a weapon to promote national interests.The core issue of international law encountered by China at that time was the revision and abolition of unequal treaties.Therefore,China actively introduced,translated,and reinterpreted theories and concepts of international law,especially the right to exist and rebus sic stantibus,so as to provide justification for China to abolish unequal treaties.Furthermore,China's application of international law on unequal treaties issue was not a peripheral voice,but also aroused discussions in the center world of international law.Many international scholars had paid attention to this issue and analyzed it.It can be concluded that China is not only a silent background and passive receiver,but also a creative player in the history of international law.
