摘要： 耕地资源是实现党的二十大提出的建设现代化农业强国的最基本的物质基础。以严格的国家管控为特点的耕地公法保护制度,不足以实现对耕地资源的有效保护。耕地保护立法应当坚持耕地保护法的社会法定位,从公法与私法制度的结合上,完善耕地保护制度。建立公法与私法结合的耕地保护制度具有现实的必要性,其理论依据在于土地所有权的社会性理论、农民对土地发展利益和经济社会发展成果的共享理论和农地法的公法私法结合的社会法理论。耕地保护立法应当建立公法私法结合的制度规范,以实现对耕地的全面保护。

Abstract: Cultivated land resources are the most basic material basis for realizing the construction of modern agricultural country proposed by the 20th National Congress of the Communist Party of China.The protection system of cultivated land public law characterized by strict state control is insufficient to realize the effective protection of cultivated land resources.The legislation of cultivated land protection should adhere to the social law orientation of the cultivated land protection law, and improve the cultivated land protection system from the combination of the public law and the private law systems.It is necessary to establish the cultivated land protection system combining public law and private law, which is based on the theory of social function theory of cultivated land ownership, the theory of sharing farmers' interests in land development and economic and social development achievements, and the social law theory combining public law and private law of agricultural land law.The legislation of cultivated land protection should establish the institutional norms combining public and private laws, so as to realize the comprehensive protection of cultivated land.
