摘要： 《中华人民共和国民法典》第1072条规定继父母与继子女间的权利义务关系。第1款规定继父母与继子女间权利义务关系的基本准则,所有继父母与继子女间均不得相互虐待或者歧视。第2款通过拟制规范将继子女与对其持续起到主要监护作用的继父母间的关系在监护的范围内拟制为生父母子女关系,适用监护制度中关于父母子女关系的规定,从而实现对行为能力欠缺的未成年继子女最大利益的保护。继父或继母满足本条第2款构成要件时,继子女可能存在生父和继母或生母和继父两位监护人,或者生父、生母和继父或继母三位监护人。前一种情况下,生父和继母或生母和继父共同管辖和决定与子女有关的事项,共同代理子女实施民事法律行为。后一种情况下,在日常生活事项范围内,与子女共同生活的生父或生母和继母或继父两位监护人共同管辖和决定与子女有关的事项,共同代理子女实施民事法律行为;在重大事项范围内,生父母双方和继父或继母三位监护人共同管辖和决定与子女有关的事项,共同代理子女实施民事法律行为。对监护关系发生争议的,可以通过协议监护、指定监护、委托监护、撤销监护人资格等制度予以解决。

Abstract: Article 1072 of the Civil Code provides the rights and obligations between step-parents and step-children.Paragraph 1 establishes the basic rule of the rights and obligations of step-parents and step-children, and that all step-parents and step-children shall not abuse or discriminate against each other.Paragraph 2 takes the relationships between the step-child and the step-parent who continues to play the primary custody role in the scope of custody as the relationships between the biological parent and the child through the fiction norm, and applies the provisions of the custody system regarding the parent-child relationship, so as to protect the best interests of the minor step-child who lacks legal capacity.When the stepfather or stepmother satisfies the constitutive elements of paragraph 2 of this Article, there are two guardians (the biological father and the stepmother or the biological mother and the stepfather), or three guardians (the biological father, the biological mother and the stepfather or stepmother). In the former circumstance, the biological father and the stepmother or the biological mother and the stepfather jointly manage and decide the matters related to the child and jointly represent the child in the implementation of civil legal acts.In the latter circumstance, within the scope of daily life matters, the biological parent living with the child and the stepfather or stepmother jointly manage and decide the matters related to the child and jointly represent the child in the implementation of civil legal acts; within the scope of major matters, both biological parents and the stepfather or stepmother jointly manage and decide the matters related to the child and jointly represent the child in the implementation of civil legal acts.Disputes over custody can be resolved through the regimes of agreed custody, appointed custody, entrusted custody, revocation of custody, etc.
