Abstract: As the foundation of the tort in Continental Legal System，the Roman tort law have three distinguishing features：The form and feature of tort liability change from blood money to damages，which showes the development of the ancient tort law；the praetor’s practice largely enriches the contents of the Roman tort law and the liability for negligence becomes the base of the rule of the modern tort law．
