摘要： 中国法律监督体系产生于中国法制近代化过程中，随着清末法制变革中都察院功能的分立而出现。清末时建立了检察厅，确立了检察机构的法律监督职能，却也存在先天的不足。北洋政府时期随着检察厅职能的独立，法律监督得到了进一步发展，但亦存在着一定的不足。考察法律监督的渊源，也对我们现今的法律监督体系的建设起到了借鉴作用。

Abstract: China’s legal supervision system，which came into being with the arising of the new function of the Censorate in the late Qing Dynasty’s judicial reform，Was established alongside the modernization of China’s legality．Even though at late Qing Dynasty，the Prosecutor’S Office was set up to perform the legal supervision function by the procuratorae，certain defects virtually existed since the Office’S birth．So Was the Prosecutor’s Office established in the era of Northern Government，even if it Was endowed with the independent excising of legal supervision responsibility．We can take reference to the origin of legal supervision in China for the improvement of China’s modem legal supervision system．
