摘要： 作为虚拟经济核心的金融，如果偏离为实体经济服务的正常轨道与价值定位，迟早都会导致金融功能异化，从而引起金融危机的爆发。本文在探讨金融功能的基础上，分析金融功能异化的表现及原因，提出针对异化的金融功能进行金融法矫治的主张。通过金融法的社会责任本位价值导向使金融回归为实体经济服务的本位，对金融主体及其行为的金融法规制使金融尽可能地走向“理性”，以更加角色化的金融法责任设置使金融活动立足于实体经济基础并承担“信用”风险，从而营造一个维护金融体系、发挥金融功能的法律秩序。

Abstract: It is the financial industry, as the core of fictitious economy, deviated from the path serving the real econo-my that mainly caused the financial crisis. The function of finance alienated into the pure fictitious and betrayed its merits and nature. This article is based on the debate about the function of finance, analyses the causation of the alienation and comes up with the method to correct the alienation of the function of finance. In the direction of the social orientation of financial law, finance will turn to the orientation of serving the real economy and through the regulation on the financial subjects and its’ behavior, the financial industry will return into rationali-ty. Under the fixed characterized financial responsibility, the financial industry will root in the real economy and assume the risk of credit in order to establish a legal mechanism which’ ll maintain the function of finance.
