摘要： 中国1915年的国体之争，既是一场宪法危机，也是中国的宪法时刻。在宪法必须出场的背景下，梁启超通过《异哉所谓国体问题者》一文，从宪法的层面论述了共和国体不容颠覆的政治主张。梁启超对国体问题的阐述，对于中国的宪法与政治产生了“共和再造”的效应。不仅如此，梁启超的国体思想，对于百余年来中国的宪法理论、宪法文本和宪法实践，也产生了潜在而深远的影响。

Abstract: The dispute of state system in 1915 was not only a constitutional crisis，but also a Chinese constitutional moment. In the background under which the constitution must play，Liang Qichao published the article“Yi zai suowei guoti wenti zhe（How Strange It is the Problem of the State System）”and discussed the political ideas that republic constitution could not be subverted. This article produced the effect of“Republic ofreengineering”．In addition，the state system thought of Liang Qichao had potential and far-reaching influence on the text of the constitution，the constitutional practice and the theory of constitution during the hundred years in China.
