摘要： 我国的司法改革在精英话语的主导下，忽视了人民群众对司法的最基本诉求。人民法院一审民事案件数量呈现递减趋势及与之相对应的信访数量大幅攀升从侧面反映了这个问题。由于没有考虑到中国国民的现实承受力和司法的基本条件，导致审判方式改革后的司’法程序在一定程度上不能为民所用。司法改革的理论和实践必须加强实证研究，充分考虑国情，在中央的整体规划下合法进行，并且应该在判断改革目标、评价改革成果的时候充分考虑到人民的意志。

Abstract: The judiciary reform of our country is dominated by the elite’s minds，neglecting the basic appeal of the common people．The number of civil action of first instance presents a descending trend and at the same time the number of letters from and calls by the people is rising rapidly．The people did not accept the reform of the model of the civil trial because it didn’t think over the practical support and basic judicial conditions．The theory and the practice of the Judiciary reform must reinforce the demonstration research，consider the situation of our country，processing under the integer programming of the Party Central．And we must think over the appeal of the common people when estimating the aim and the harvest of the reform．
