摘要： 法国现代调解制度的发展是本土资源和外来经验结合的产物。它是传承18世纪法国大革命时期的调解立法，借鉴英美法系调解经验的基础上，在法国现代社会条件下发展的结果。法国的调解目前已形成独具特色的模式，即由国家依附型调解和社会自治型调解组成的混合模式。而从国家依附型调解逐渐过渡到社会自治型调解，已成为法国调解改革的基本方向。

Abstract: The modern French mediation is a combination of innovation between local resources and foreign experience. In detail, it is the conciliation legislation heritage during the Revolution of 18th Century, combined with the Anglo-American mediation experience, according to the modernization conditions of the French society, finally producing the innovative results. Today, French mediation apparently has formed its own characteristics of the modern mode, composed of National-dependent conciliation and social self-dependent mediation. From National-dependent conciliation to social selsf-dependent mediation is the future of the modernization of French mediation.
