摘要： 《民法总则》中的民法特别法链接条款，将民法特别法整合到民法之中，使之与民法普通法相衔接，构成民法全部体系的一般条款和特别条款。其法律功能在于强调某种民法特别法的私法属性、民法特别法所保护的民事主体的特殊地位、对特殊民事主体的私法保护政策或者通过该条款对侵权特别法的链接而实现民法体系的一体化。《民法总则》规定民法特别法链接条款的目的，就在于确定民法特别法的优先适用效力。

Abstract: The rules about the link clauses of special regulations of civil law in General Principle of Civil Code integrate special provisions into the civil law to make them comply with the general civil law and constitute the general clauses and special clauses in the system of civil law.As for its legal function, first of all, it emphasizes the private nature of special regulations of civil law.Secondly, it emphasizes the special status of the civil subject protected by the special regulations of civil law.Further-more, it emphasizes the private law's protective policy on the special subject of civil law.Finally, it emphasizes linking the clauses to the special tort law to realize the integration of the system of civil law.The purpose of the regulations of link clause in General Principles of Civil Code is to determine the prior effect of the special regulations of civil law.
