摘要： 美国财产征收中的公正补偿具体体现为公平市场价值标准。被征收财产的公平市场价值是一种虚拟状态下的市场交易价格，需要通过各种评估技术手段予以确定，并以财产的最高最优使用为基础。依据公平市场价值标准确定的补偿是不完全赔偿也是非个性化赔偿，经过美国一个多世纪的司法实践却被证明是最为经济有效的补偿标准。我国征收补偿制度的改革应当借鉴美国公平市场价值标准的经验，剥离附着于征收补偿的社会保障功能，建立以被征收财产价值为核心的补偿制度，确立公平市场价值标准和最高最优使用规则。

Abstract: The just compensation of eminent domain in the United States is measured by the Fair Market Value （FMY） Standard. The FMV of the property taken is a fictitious market transaction price, which should be calculated through a variety of assessment techniques, and based on the highest and best use of the property taken. Although FMV Standard is characterized by incomplete and non-personalized compensation, it has been proven to be the most economic and effective compensation Standard in eminent domain by American judicial practice. Thus, it is suggested that China should detach the social security function, which is always attached to, from the compensation in eminent domain, base the compensation on the value of the property taken, and then set up the FMV Standard and the highest and best use rule.
