摘要： 在现代社会，标准与专利的结合日益频繁和广泛，使得两者的市场影响力得以扩大，因而在涉及专利的标准制定和实施过程中容易发生排除、限制市场竞争的问题。违反专利披露义务和虚假承诺可能引起的反垄断问题以及违反公平、合理、无歧视原则可能引起的反垄断问题是两个典型的表现。这两个问题都需要在反垄断法禁止滥用市场支配地位制度的框架下进行合理性分析，涉及行为主要包括拒绝许可、不公平要价、价格歧视、搭售或者附加其他不合理的交易条件，以及不正当地寻求禁令救济等，需要着重把握其特殊之处。

Abstract: In modern society，combination of standard and patent is increasingly frequent and extensive，whichexpands market effects of the two. Thus，problems of eliminating or restricting competition occur in theprocess of the setting and enforcement of standards related to patent. There are various forms of the issues，and two of the most typical and outstanding performances are the anti-monopoly issue caused by the violationof the obligation of the patent disclosure and the false promises and the anti-monopoly issue of caused by violation of the fair, reasonable and non-discriminatory principle. The two issues need to be analyzed in theframework of systems of forbidding abuse of market dominance，and need to focus on the special aspects. The conducts mainly include refusal of license，unfair pricing，price discrimination，tie-in sales orimposing any other unreasonable transaction terms and seeking unfairly the relief of the injunction.
