摘要： 自19世纪中叶,前现代的中国被迫与现代国际法系统接触,中国启动了认知及应用国际法、建设现代化国家、参与国际秩序建构的进程。在相当长的历史时期内,中国面临着前现代性积弊革除、现代性充实与确立的使命,并进而承担起反思现代性的偏差与不足、超越现代性的多重任务。此种历时性问题共时性解决的境况同样投射于国际法领域,成为中国国际法理论的叙事主线和实践发展的长期使命。中国式现代化的建设,要求推动国际法走向符合时代要求的现代化进程,保证国际法促进全球和平、合作、和谐,摆脱中国社会文化的前现代情境,弥补不了解国际法、不熟悉国际法、不善用国际法的课程;在现代国际法环境中完善自身的知识与能力、提升在国际法形成与运行过程中的参与性;检视、洞悉和反思既有现代性国际法所存在的缺陷和问题,通过预防和避免其规范的负面表现与运行的消极后果来实现国际法现代性的超越,积极促进国际法的改善和提升,保证国际法为中国式现代化提供良好的外部制度环境。

Abstract: Since the mid-19th century, pre modern China has engaged in systematic interaction with modern international law, initiating the process of recognizing and applying international law, building a modern country, and participating in the construction of global order.For a considerable period of history, China faced the mission of eliminating the accumulated shortcomings of pre modernity, enriching and establishing modernity, undertaking the multiple tasks of reflecting on the deviations and shortcomings of modernity, and transcending modernity.The situation of solving this historical problem in a synchronous manner is also projected onto the field of international law, becoming the narrative mainline of Chinese international law theory and the long-term mission of practical development.The problems we need to solve include getting rid of the pre modern context of Chinese society and culture, and refining courses that lack understanding, familiarity, and effective use of international law.This also includes improving one's knowledge and abilities in the context of modern international law, enhancing participation in the formation and operation of international law.It also includes examining, understanding, and reflecting on the shortcomings and problems of modern international law, actively promoting the improvement and enhancement of international law by preventing and avoiding negative manifestations and consequences beyond the modernity of international law.As the main planner and designer of the world order, China is taking on global responsibility to promote the modernization process of international law that meets the requirements of the times, ensure that international law promotes global peace, cooperation, and harmony, and provide a favorable external institutional environment for China to build a prosperous, democratic, civilized, harmonious, and beautiful modern country.
