摘要： 近年来，博客侵权案件不断增多，并引起了社会各界的广泛关注。本文主要对博客侵权的现状、博客侵权的构成要件、博客侵权的司法认定、博客侵权民事责任之承担等进行初步探讨，以期对博客侵权及其立法规制有所裨益。

Abstract: In recent years，the blog infringement cases are increasing，and people have put extensive attention on them．This paper mainly gives a preliminary discussion on the status of blog infringement，the constitute elements of the blog infringement，the judicial finds of the blog infringement，the civil liability of the blog infringement in order to benefit the research and the legislation on the blog infringement．
